WhyDonate

WhyDonate B.V. and Stichting WhyDonate, based in Amsterdam, Chamber of Commerce 58485317 / 58490280.

User

Any individual or legal entity using the platform, including donors and organizers.

Campaign Organizer (Beneficiary)

An individual or organization with a social or charitable goal raising funds through WhyDonate.

Platform

The WhyDonate software and services available at https://whydonate.com.

Payment Processor

Stripe or any other external payment service provider used by WhyDonate.

By creating an account, making a donation, or launching a campaign, you enter into an agreement with WhyDonate and accept these terms.

WhyDonate may update these terms. Significant changes will be communicated via email or the platform. Continued use means you accept the new terms.

• All provided information must be accurate and current.
• The platform must not be used for illegal, deceptive, or non-charitable commercial purposes.
• We may remove, edit, or reject accounts or campaigns that violate these terms or legal obligations.

Campaigns must:

• Be transparent about the use of funds;
• Not include misleading or fraudulent information;
• Not contain hateful, sexually explicit, racist, or otherwise inappropriate content.

Users are responsible for their content. WhyDonate performs random checks and may act on complaints.

• Donations are non-refundable unless fraud or misuse is confirmed.
• Payouts occur weekly, monthly, or on demand via your dashboard.
• Identity and bank account verification are required for payout.
• Transaction fees are deducted as per current rates (see fees).
• Chargebacks incur fees: €7.50 (SEPA), €20 (credit card).

• Refunds are only issued in cases of verified fraud or misuse, and only if the funds haven’t yet been paid out.
• Requests can be submitted via [email protected]. WhyDonate will review and respond accordingly.

• Suspend or terminate accounts and campaigns.
• Hold or recover payouts.
• Share user data with authorities.
• Pursue legal action.

• All content on the platform is owned by WhyDonate or its licensors.
• Uploaded materials grant WhyDonate a royalty-free, non-exclusive license for service provision.
• You may not copy, alter, or reuse platform content without written consent.

• We communicate via email and WhatsApp regarding donations, updates, and service notifications.
• You may opt out of non-essential messages through your settings.

• We process data according to the GDPR.
• Data is shared only when necessary (e.g. for payment processing).
• Donor details are visible to organizers unless the donation is anonymous.
• Organizers are responsible for lawful data handling.

At WhyDonate, the security and proper handling of the funds you raise are our highest priority. This section explains how we protect all donations collected through your campaign.

Segregated Account for Your Funds

All donations made to fundraisers are held in a separate, third-party bank account. This account is fully independent from WhyDonate’s own business accounts. This means your donors’ money is kept completely separate and is never used for our company’s operational expenses.

Independent Management

This structure ensures that the funds are protected and managed solely for the purpose of being transferred to you, the verified campaign organizer or beneficiary.

Our Payment Processor

WhyDonate uses Stripe, a globally recognized and regulated payment processor, to handle all financial transactions. Stripe provides and maintains the segregated third-party account where your funds are securely held before they are transferred to you.

Your Assurance: The segregation of funds guarantees that:

1. Donations are collected and held on your behalf.
2. Funds are secure and cannot be accessed or used by WhyDonate for any other purpose.
3. Funds can only be paid out to you, the verified fundraiser creator, or your designated beneficiary.

This process is designed to comply with financial regulations and to provide full transparency and security for both fundraiser creators and their donors.

• We are liable only for direct damage, capped at the amount of the related donation.
• We are not liable for indirect damage or third-party actions.
• This exclusion doesn’t apply in cases of gross negligence or intent.

• Dutch law applies to these terms.
• We aim to resolve disputes amicably.
• If needed, disputes are handled by courts in Amsterdam or Haarlem.
